1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Otternest ("we," "us," or "our"). By using our services, you acknowledge that you have read, understood, and agree to these Terms.

2. Nature of Activities & Assumption of Risk

Otternest specializes in wilderness survival training, outdoor leadership programs, and jungle expeditions. You acknowledge that:

• Inherent Risks: Our activities take place in natural, uncontrolled environments. Risks include, but are not limited to, uneven terrain, wildlife interactions, weather conditions, and physical exertion.
• Physical Fitness: Participants must ensure they are medically and physically fit to participate. It is your responsibility to disclose any medical conditions or limitations prior to booking.
• Voluntary Participation: You voluntarily assume all risks associated with participation in our programs. Otternest, its staff, and affiliates are not liable for personal injury, property damage, or loss, except where caused by gross negligence.

3. Bookings and Payments

Bookings: All bookings for camps and corporate programs are subject to availability and confirmation by Otternest.

Payments: Full payment or a specified deposit is required to secure a booking. We accept payments via the methods indicated on our invoices or booking portal.

Infrastructure Orders: Orders for Otternest infrastructure (tents, cabins, modular units) are governed by specific sales agreements provided at the time of quotation.

4. Cancellation and Refund Policy

Due to the logistical complexity of our operations:

• Cancellations by You: Cancellations made more than 30 days prior to the program start date may be eligible for a partial refund, subject to an administrative fee. Cancellations made within 30 days are generally non-refundable.
• Cancellations by Us: We reserve the right to cancel or reschedule programs due to extreme weather, safety concerns, or insufficient enrollment. In such cases, you will be offered a reschedule date or a full refund.

5. Code of Conduct

Participants are expected to uphold high standards of conduct:

• Respect for Nature: Strictly follow "Leave No Trace" principles. Destruction of flora or fauna is prohibited.
• Safety Protocols: You must strictly adhere to all safety instructions given by Otternest instructors. Failure to comply may result in immediate removal from the program without refund.
• Harassment: We have a zero-tolerance policy for harassment or abusive behavior towards staff or other participants.

6. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Otternest and is protected by copyright and intellectual property laws. You may not use, reproduce, or distribute our content without express written permission.

7. Data Privacy

Your use of our services is also governed by our Privacy Policy. By seeking our services, you consent to the collection and use of your information as outlined therein.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
